The UK GDPR test: where does your data actually live?

For UK organisations, this is often the most consequential difference between the two platforms. The compliance landscape here has genuinely shifted since this guide was first drafted.

Important correction: the EU-UK adequacy decision did not lapse. It was extended on a technical basis through 27 December 2025, to give the European Commission time to assess the UK’s Data (Use and Access) Act 2025. On 19 December 2025, the Commission renewed the adequacy decision for a further six years, through to 27 December 2031. UK organisations can continue to rely on the adequacy framework for EU-to-UK transfers.

What has changed on schedule: key provisions of the UK’s Data (Use and Access) Act 2025 (DUAA) came into force on 5 February 2026. These provisions update requirements around lawful processing, data subject request timeframes, “recognised legitimate interests,” and international transfer tests. A further provision, the statutory right to complain directly to a data controller, comes into force on 19 June 2026.
